These terms and conditions govern your use of the Kellett & Co client portal and the services we provide through it. By creating an account or using the portal, you agree to be bound by these terms. Please read them carefully.

1. About these terms

These terms apply to the Kellett & Co client portal at kellettandco.app and to the property management services we provide through it. They are between you (the user) and Kellett & Co, based at Cotton Court, Church Street, Preston, PR1 3BY.

2. Who can use the portal

The portal is for authorised users only. Access is granted by Kellett & Co to landlords, tenants and contractors associated with properties we manage. You must not allow anyone else to use your account or share your login details.

3. Your account

You are responsible for keeping your password secure and for all activity that takes place under your account. If you believe your account has been compromised, you must tell us immediately. We may suspend or terminate your access if we suspect unauthorised use or a breach of these terms.

4. Using the portal

You agree to use the portal only for lawful purposes and not to:

• Provide false or misleading information.
• Upload content that is unlawful, harmful or offensive.
• Attempt to gain unauthorised access to the portal or other users' data.
• Interfere with the operation or security of the portal.

5. Information you provide

You agree that the information you provide through the portal (including maintenance requests, messages and uploaded documents) is accurate to the best of your knowledge. You are responsible for ensuring any information you share does not infringe the rights of others.

6. Maintenance and repairs

Maintenance requests submitted through the portal are logged and reviewed by our team. Response times depend on the nature and urgency of the issue. We will keep you updated through the portal, by email or by telephone. Emergency repairs should also be reported by telephone on 01772 284898.

7. Rent and payments

Rent payment records and statements displayed in the portal are provided for information purposes. The legal obligations for rent payment are set out in your tenancy agreement. If you believe there is a discrepancy, please contact us so we can investigate.

8. Documents and certificates

Compliance certificates and tenancy documents made available through the portal are provided for your reference. Where originals are required, these will be provided separately. You should keep your own copies of important documents.

9. Availability of the portal

We aim to keep the portal available at all times, but we cannot guarantee uninterrupted access. Maintenance, updates or technical issues may occasionally make the portal unavailable. We are not liable for any loss caused by temporary unavailability.

10. Our liability

We take reasonable care to ensure the information on the portal is accurate, but we cannot guarantee it is always complete or up to date. To the fullest extent permitted by law, Kellett & Co is not liable for any indirect or consequential loss arising from your use of the portal. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

11. Data protection

We handle your personal information in accordance with our Privacy Policy, which is available on this website. By using the portal, you consent to us processing your information as described in that policy.

12. Changes to these terms

We may update these terms from time to time. We will post the updated version on this page and, where appropriate, notify you by email. Your continued use of the portal after changes are made means you accept the updated terms.

13. Termination

We may suspend or terminate your access to the portal at any time if you breach these terms or if we are no longer instructed to manage the property concerned. You may stop using the portal at any time.

14. Governing law

These terms are governed by the laws of England and Wales. Any dispute will be dealt with by the courts of England and Wales.
